When planning authorities decide on a planning change \u2014 for example, the approval of a new zoning plan (Taba), granting a variance, or permitting a non-conforming use \u2014 this may significantly increase the value of the land or property owned. In such cases, a gap is created between the property\u2019s value before the change and its value afterward.<br \/>The betterment levy is intended to regulate this economic benefit and to balance the profit generated for the property owner as a result of the public authority\u2019s action.<\/p>\n\n<p>In simple terms, it is a tax that a property owner is required to pay to the local planning and building committee when a plan or variance is approved that increases the value of their property. In this way, the state seeks to implement distributive justice: if society as a whole, through its planning authorities, enables an increase in the property\u2019s value, then part of the profit should be returned to the public.<\/p>\n\n<h2 class=\"wp-block-heading\">What is a betterment levy?<\/h2>\n\n<p>The betterment levy is a mandatory payment first introduced in the Planning and Building Law in 1981. Its purpose is to require a landowner to pay the local committee half of the increase in the property\u2019s value resulting from one of three main factors:<\/p>\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>Approval of a new plan \u2013 for example, a plan that rezones land from agricultural to residential use, or a plan that allows for taller construction.<\/li>\n\n<li>Granting of a variance \u2013 for example, a relaxation of existing zoning provisions, such as reducing building setback lines, adding extra floor space beyond what is permitted, and similar changes.<\/li>\n\n<li>Granting of a non-conforming use \u2013 allowing a property to be used for a purpose that does not match its current zoning, such as converting a residential apartment into an office.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">How is the betterment levy calculated?<\/h2>\n\n<p>The calculation is based on a real estate appraiser who assesses the value of the property before and after the approval of the plan or variance.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Previous value: the valuation of the land or property before the planning change was made.<\/li>\n\n<li>New value: the valuation of the land or property after the change.<\/li>\n\n<li>Betterment: the difference between the new value and the previous value.<\/li>\n\n<li>Betterment levy: half of the betterment amount.<\/li>\n<\/ul>\n\n<p>Example:<br \/>If agricultural land was valued at 1,000,000 NIS before the approval of a plan, and afterward (when rezoned for residential use) its value rose to 3,000,000 NIS, the betterment is 2,000,000 NIS. The levy is 50% of that amount, i.e., 1,000,000 NIS.<\/p>\n\n<h2 class=\"wp-block-heading\">When is the payment actually due?<\/h2>\n\n<p>Although the betterment arises at the moment the plan is approved, the property owner is not required to pay the levy immediately. The obligation becomes relevant when the landowner:<\/p>\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>Sells the property \u2013 in order to receive approval for the transaction at the Land Registry, the owner must present the local committee with confirmation of payment of the levy or proof of exemption.<\/li>\n\n<li>Obtains a building permit \u2013 for example, if the owner wishes to utilize the additional building rights that were granted.<\/li>\n\n<li>Makes actual use of the rights \u2013 such as in cases of non-conforming use.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\">Who pays the levy?<\/h2>\n\n<p>The obligation falls on the property owners or long-term lessees (those holding a lease for more than 25 years). When there are multiple owners, the payment is divided according to each owner\u2019s proportional share in the property.<\/p>\n\n<h3 class=\"wp-block-heading\">Exemptions from the betterment levy<\/h3>\n\n<p>The law recognizes situations in which the property owner is not required to pay the levy. Among the exemptions are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Properties designated for public use (schools, synagogues, shelters, etc.).<\/li>\n\n<li>A single residential dwelling that the owner built or expanded for personal use (up to a certain size and subject to conditions).<\/li>\n\n<li>Properties whose betterment results from certain national master plans (for example, TAMA 38 in specific cases).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Disputes and appeal procedures<\/h2>\n\n<p>Since the levy is based on property valuations, disputes often arise between property owners and local committees. A property owner may submit a counter-appraisal against the valuation prepared by the committee\u2019s appraiser. If no agreement is reached, the matter can be referred to a deciding appraiser appointed by the Council of Real Estate Appraisers at the Ministry of Justice. The deciding appraiser\u2019s decision is considered final, though it may still be appealed to the Administrative Court in exceptional cases.<\/p>\n\n<h3 class=\"wp-block-heading\">Betterment levy vs. capital gains tax<\/h3>\n\n<p>Many people confuse the two concepts. While capital gains tax is collected by the Tax Authority upon the sale of a property (based on the increase in value from the time of purchase until the sale), the betterment levy is collected by the local committee on the increase in value resulting from planning actions. In fact, a property owner may be required to pay both capital gains tax and a betterment levy, each to a different authority and for different reasons.<\/p>\n\n<p><strong>Public and economic criticism<\/strong><\/p>\n\n<p>The betterment levy is intended to create a balance between the public good and private interest, but it also has its critics. Some argue that it is an additional tax that makes it harder for property owners to exercise their rights, increases project costs, and slows development. On the other hand, supporters claim that it is a fair and essential tool, ensuring that profits resulting from planning decisions are also shared with the public (through development budgets, infrastructure, and municipal services).<\/p>\n\n<p>The betterment levy is one of the central tools in Israel\u2019s planning and building system. It reflects the principle that planning betterment is not the sole privilege of the property owner but rather the result of a public action that must be shared. The levy, calculated on the basis of a professional appraiser\u2019s assessment, is intended to ensure a fair distribution of profits and to strengthen the resources of local authorities.<\/p>\n\n<p>At the same time, the levy raises questions of fairness, economic efficiency, and its impact on the real estate market.
